Sale of Samsung Galaxy Tab 10.1 Allowed in USA
TNI Bureau: Providing a big relief to Samsung, a US court uplifted the sales ban on the South Korean company’s Galaxy Tab 10.1 on Monday. Now, the product can be sold in the United States. Samsung and Apple Inc. had been engulfed in a patent dispute since a while.
The jury held that the sole basis for the preliminary injunction no longer exists since the jury found that Samsung’s Galaxy Tab had not violated Apple’s D’889 patent.
Apple had won at several occasions earlier in the legal hassle between the world’s two huge tech companies. The company had moved to the court against Samsung claiming patent violation.
US District Court Judge Lucy Koh issued the order allowing Samsung to renew sales of the Galaxy Tab 10.1. Earlier, a jury held on August 24 that Samsung should pay Apple $1.049 billion in damages for illegally copying iPhone and iPad features. But, the jury found that Samsung had not violated the patent that was the basis for the tablet injunction.
Samsung is also expected to launch the second generation of one of its most successful devices, the stylus-equipped Note in a month.
Though the Galaxy 10.1 is an older model from Samsung, removing the sales ban on the tablet is expected to add a huge amount of sales to the company.
Apple Inc. and Samsung are the world’s two leading Smartphone makers and they are entangled in legal disputes in 10 countries.
It is also heard that Samsung filed a case against Apple saying the iPhone 5 had infringed on some of the company’s patents in a separate move.
