Delhi Gangrape: 17-year-old Accused declared ‘Minor’

TNI Bureau: After rejecting Janata Party president Subramanian Swamy’s plea, the Juvenile Justice Board on Monday ruled that the 17-year-old accused in the Delhi gangrape case was a ‘minor’.

The Board presided over by Principal Magistrate Geetanjali Goel said that there was no doubt about birth certificate of the accused.

Reacting to the ruling, the prosecution said that they will move to the higher court against the decision. There was no bone marrow test conducted on the accused to know the actual age of the accused.

Since the accused was declared as a juvenile, he will get no more than 3 years in jail. He will be tried under the juvenile act.

Earlier, Swamy had appealed to the Board that the juvenile should be prosecuted like all other co-accused in the case. He had referred the Juvenile Justice (JJ) Act and the Indian Penal Code (IPC). While JJ Act considers above 18 as adults, IPC says below 12 as minor.
