PUC can’t be denied in case of Unpaid Fines: Orissa High Court

TNI Bureau: The Odisha government has withdrawn its proposed “No Pollution Under Control Certificate (PUCC), No Petrol” rule after directions from the Orissa High Court. The rule was earlier scheduled to come into effect from April 1.

The Orissa High Court has also directed the government to allow the issuance of PUCCs to vehicle owners even if they have pending traffic challans, clarifying that unpaid fines cannot be a ground to deny pollution certificates.

In addition, the court has instructed the government to make necessary technical changes to the Vahan portal to implement the decision. The state has been asked to submit an affidavit confirming that the required updates have been completed.

The rule was originally introduced as part of efforts to curb vehicular pollution, but was withdrawn following legal scrutiny.
