CBI is an organisation to indict those in power and riches; its record shows that through unconventional methods of inquiries, it commands respect from the common people in India. Notwithstanding its supremacy, the organisation is still clueless about many incidents of crimes and cheatings and it has thrown in the towel after drawing blank from the dark nature of incidents.

CBIThe five cases, where CBI inquiry has withered in the vine, are mentioned below:

Ottavio Quottrochi

Perhaps, Bofors remained the longest pending scandal in political history of India. Raising a political storm in the nation for the involvement of then prime-minister late Rajiv Gandhi, the case began in the eighties and ended on a completely dissatisfactory note in the year, 2009. The involvement of CBI in trailing the main conduit in the case, Ottavio Quottrochi, continued for almost one and half decade, finally zeroing  in on nothing. The riddle behind the curtain of Bofors case still remains unsolved.

Aarushi murder case

Although hundreds of heartless murders take place every day in India, the intriguing nature of the killing of the teenager in New Delhi, Aarushi, jolted the conscience of the nation that brought a collective claim from people to conduct an impartial inquiry by CBI. Although, the incident took place on 16th May, 2008, the investigation has hardly shown any progress, while the public waits with bated breath to know what happened to the lives of the innocent teenager and the domestic servant, Hemraj.

Nithari killings

It appeared from the dark nature of deaths in Nithari case that the culprit was inspired by the classic of Alfred Hitchcock- Psycho.  The gruesome serial killings were discovered by the local people of Nithari-a small area in Noida near New Delhi. Although, the owner of that particular palatial house Moninder Singh Pandher and his servant Surender  Koli were arrested on the charges that they murdered the innocents in their house on the pretext of giving them work,  doubts persist that number of those killed was never actually ascertained. CBI has finally failed to convict the main accused Moninder Singh Pandher, passing the bucks entirely to his servant, Koli.

Anti-Sikh Riots

The year 1984 saw the serial pogroms of members of Sikh community that took place in the wake of ex-prime minister Indira Gandhi’s assassination.  Although, CBI was entrusted with the inquiry work of ascertaining the role of Congressman Jagdish Tytler, years of inquiry went in vain when the agency filed a closure report in the court. Later in April 2013, the Karkardooma court in Delhi passed a historic verdict by rejecting the CBI’s closure report and ordered a fresh probe into former Union Minister Jagdish Tytler’s role in the 1984 anti-Sikh riots. The court also disapproved the clean chit given by the CBI to Tytler in 2007 and 2009.

Coalgate

The credibility of CBI came under a cloud, when the Supreme Court directed the government to make the agency an autonomous body. The apex court came down heavily on the CBI and the government by terming the agency a “caged parrot” after the CBI Director Ranjit Sinha admitted that the probe report into the allocation of coal blocks was shared with the former law minister Ashwani Kumar and officials of the Prime Minister’s Office and the coal ministry.

Comptroller and Auditor General (CAG) Vinod Rai retires today. He will be replaced by Defence Secretary Shashi Kant Sharma. Mr. Rai will be remembered for the audit reports on 2G, CWG and Coalgate that created political storm.

Mr. Rai had dared to expose the UPA government with many audit reports on the allocations of 2G spectrum, 2010 Commonwealth Games and coal mining blocks. The reports showed massive scams that ruined the government’s image and provided ammunition to the main opposition to corner the Congress in the Parliament.

Mr. Rai, who worked following the ethics, talked about good governance and transparency when the government was criticised for a number of corruptions and scams. His five-year tenure (2008-2013) had been controversial for talking tough against the government.

A day before his term ended as CAG, he appealed to the government to allow the body to audit Panchayatiraj institutions for greater transparency.

Meanwhile, India Again Corruption (IAC) activist and senior lawyer Prashant Bhushan has questioned the selection of Shashi Kant Sharma, who will be the new CAG. He raised the issue of reform in the selection process saying, there was a conflict of interest in the appointment. He alleged that the government has selected such a person, who will work following the instructions of the political masters and ultimately, the CAG will be a toothless body.

Under the attack from the Supreme Court, the UPA government on Tuesday formed a GoM to decide the autonomy of the CBI, which was called a “caged parrot” last week after it filed an affidavit on the Coalgate report.

The groups of ministers (GoM) will be headed by the finance minister P Chidambaram. It will look into the apex court’s directives on CBI autonomy.

The apex court had raised a question on the functioning of the CBI in the Coalgate report after the investigating agency admitted that the report was shared with the Law Minister, officials of the PMO and Coal Ministry.

Coming down heavily on the CBI, the court called it a caged parrot working for the political masters. The court had directed the government to make the institution autonomous for impartial probe. The government has been given the deadline July 10 to separate CBI from its influence.

Today was the black Friday for Congress-led UPA government as two of its ministers resigned from their posts after Congress President Sonia Gandhi instructed them to do so. Law minister Ashwani Kumar quit following the resignation of railway minister Pawan Kumar Bansal. Ashwani was under fire from the opposition after the Supreme Court came down heavily on the CBI for allowing the law ministry to change the draft of CBI probe report on Coalgate.

Earlier in the evening, Pawan Kumar Bansal had resigned from his post. He quit at around 9 pm, while Ashwani tendered his resignation after 50 minutes, i.e. 9:50 pm. This comes in the wake of a meeting between Prime Minister Manmohan Singh and UPA chairperson Sonia Gandhi.

Bansal was bound to resign after his nephew Vijay Singla was arrested in a railway bribery case. He was accused of trying to fix the promotion for a member in the railway board.

Despite uproar in the parliament by the opposition members, the PM and Bansal had been avoiding to give replay on this matter. Similarly, the pressure was high on Ashwani after the apex court slammed the CBI calling the investigating agency a “caged parrot”.

CBI Director Ranjit Sinha triggered a massive outrage across the nation with his brazen defence for sharing the coalgate status report with the Law Minister before it was filed in the Supreme Court. He claimed that CBI was part of the government and not autonomous.

While talking to the media, Ranjit Sinha said that he did no wrong by showing the coalgate status report to the Law Minister, as he was not an outsider. “The CBI is not an autonomous body. I am part of the government. I have shown the report to the Law Minister of the country,” he added.

Earlier, the CBI Director had admitted that changes were made to the original draft after the meeting between the CBI and Law Ministry. He has already given all details to the Supreme Court, which will give its verdict on May 8.

TNI Bureau: Amidst the growing pressure from the opposition BJP over the coal blocks allocation scam, the Supreme Court slapped the UPA government issuing a notice over the alleged irregularities in the allocation.

The coal ministry will have to explain whether there were irregularities in the allocations, within 8 weeks. The notice was issued in response to a public interest litigation (PIL) seeking cancellation of 194 coal blocks allotted during 2005-2011.

The PIL alleged that the coal blocks were allotted to the companies, those had no mining plan. Meanwhile, the coal ministry has cancelled the allocation of four companies and the bank guarantee of one of them has been encashed.

The blocks cancelled were the Bramhadih block in Jharkhand allotted to Castron Mining Ltd; Chinora and Warora (Southern Part) blocks in Maharashtra allotted to Field Mining and Ispat Ltd; and Lalgarh (North) block in Jharkhand allotted to Domco Smokeless Fuels Pvt. Ltd.

The government also cancelled the Marki Mangli-II, III and IV block allotment in Maharashtra allotted to Shri Virangana Steels Ltd and the bank guarantee encashed on Thursday.

TNI Bureau: Union Minister of State in the PMO, V Narayanasamy took on BJP over coal blocks allocation holding the main opposition responsible for disrupting the proceedings of Parliament that ended with no work.

Addressing a press conference at Congress Bhavan in Bhubaneswar today, the Minister of State for Parliamentary Affairs, Narayanasamy defended the UPA government on Coalgate saying the guidelines for the coal blocks allocation were made in a transparent manner.

The CAG report on Coalgate, which rocked the parliament during the monsoon session, has never said the allocation was a scam, he said. It is the BJP, has been sarcastic about the CAG. Normally, the ruling government never wants to have a debate on any issue in the House, but the UPA invited all the parties to discuss the issue, but the opposition continued stalling the parliament.

He said that Congress alliances and all major political parties wanted a debate on the issue except BJP and JDU. He asked why the BJP is running away from the discussion.

The demand for resignation of the Prime Minister Manmohan Singh is unjustified as he has submitted a statement saying he is ready to discuss the issue. Before asking for resignation of the PM, the chief ministers of the BJP-ruling states should resign, he said.

The Congress leader slammed the opposition for destabilizing the government saying the party could not come to power in 2004 and 2009, so trying to disturb the government as they cannot wait for 2014 elections.

Defending the charges by the opposition, he said that the coal blocks allocation was done by the recommendation of the screening committee, which also consists of officials from the states. Presenting some key details of the allocation, he said that the BJP is now blaming the UPA for the scam, but it is not asking the CMs of its states why they recommended the allocation. He said that the Central government cannot go for allocation without the support of state government.

He alleged that Naveen Patnaik government had recommended in favour of Jindal, while hundreds of people wanted the allocation.

Justifying the allocation, he said that the coal blocks were given for the purpose of power production. But Odisha along with other BJP-ruling states had opposed it. He also said that BJP is opposing the CBI probe into the matter as action is inconvenient to the party.

However, Narayanasamy’s chief purpose of visiting to Odisha remained unclear. Congress leader Jagdish Tytler, who is in charge of the state, was present along with OPCC chief Niranjan Patnaik at the press conference, which was held amidst the growing demand for arrest of Tytler over his alleged provocative speech against the CM Naveen Patnaik at the Congress rally on September 6. Even the leaders came a day before the scheduled date of their Odisha visit.

TNI Bureau: Prime Minister Manmohan Singh slammed BJP for disrupting the proceedings of Parliament. He said that there were important issues needed to be debated in both the Houses, but the Opposition paralysed the Monsoon session over Coalgate.

Talking to reporters outside Parliament on last day of the session today, Dr Singh said that India is going through many problems like ethnic violence, terrorism, naxalism and these issues should have been discussed in the parliament.

Avoiding the Coalgate issue, he said that the world is grappled with economic crisis and the parliament should have discussed such issue. He appealed to the countrymen to reject the BJP, which is not allowing the government to run the parliament smoothly.

“This is negation of democracy. Violation of norms of the Parliament and constitution that we have understood”, he said.

Dr Singh said that he has a great respect for CAG. Hence, its findings should be discussed. The PM broke his silence after both the houses of Parliament were adjourned sine die today following the uproar over the coal blocks allocation scam and reservation in job promotions for SC/ST.

The session ended with no discussion and little work. Around Rs 10 crore losses occurred due to continuous disruption and uproar in the Parliament. 80% of work hours were lost and six out of 31 bills were passed in this session.

Late, the opposition BJP held the press conference to make their stand clear before the media over Coalgate. Leader of Opposition in Lok Sabha Sushma Swaraj lashed out at the government for casual response on the matter.

She said that BJP will take the fight to the streets. “We will plan how to take this issue to the people in the villages”, she said.

The core group of the party will meet on September 13 and decide how to take the issue to the villages.

Backing her, senior BJP leader Arun Jaitley questioned the PM’s statement as the coal scam was not there. He said that PM told the issues of ethnic violence and terrorism, but the country is facing the issue how to clean up the entire process of allocation of natural resources.

He asked why the government is blaming the CMs of the states, whereas the CAG report said that the PMO had approved the coal block allocation on July 25, 2005.

Also the audit report said that all the ministers and businessmen connected to the UPA were allotted to the coal fields.

“We asked them to cancel allotments, they didn’t agree to that. UPA is a regime that is committed to cryptocracy. Let the centre have a commission of inquiry where PM has to depose, all issues will be covered”, he said.

TNI Bureau: While the fate of the 60 coal blocks is in suspense, the Central Bureau of Investigation (CBI) has filed FIRs against five companies in connection with the coal block allocation that caused a huge loss of Rs 1.86 lakh crore to the country.

The cases have been registered under cheating and criminal conspiracy against companies that include Vinni Iron and Steel, Nav Bharat Steel, JLD Yavatmal, JAS Infrastructure and Power and AMR Iron and Steel, the owner of the companies and some unknown officials of the Coal Ministry and state governments.

The officials, who were involved in the allocation of coal blocks during 2006-09, are under scanner.

The investigative agency is also carrying out the raids across the country in the cities including Kolkata, Patna, Hyderabad, Dhanbad, Nagpur, Mumbai and Delhi.

Meanwhile, the agency is also taking action on the basis of the Comptroller and Auditor General (CAG) report on Coalgate, which was tabled in the Parliament.

TNI Bureau: Following statement of Prime Minister Manmohan Singh in the Parliament, where he named Odisha as one of the major coal-bearing states, the BJD and Congress have indulged in a ‘Coalgate War’ in the state.

While Odisha PCC President has accused Chief Minister Naveen Patnaik of adopting a double standard over coal scandal, he claimed that the state government had strongly recommended allotment of coal blocks to private companies and opposed allocation through auction.

PCC President Niranjan Patnaik also intimated about their plan for a gherao of the state Assembly edifice on September 6 and demanded Naveen’s resignation on moral grounds.

On the other hand, the ruling BJD supremo Naveen Patnaik reacted to the allegations of the PCC president that CAG has castigated the Centre and not his government.

However, yesterday’s development has put Naveen Patnaik in a tight spot, while strengthening the Congress’ claims and allegations further. A leading TV channel, quoting Naveen Patnaik’s letter on June 22, 2002, has claimed that he had favoured Jindal Steel and Power Ltd for coal block allocation.
